Whether it is the result of leaking containers, spills, or expiration dates, products containing hazardous chemicals are required to be transported and disposed of according to stringent federal, state, and local regulations.
Challenges
As the generator (our customer), according to RCRA regulations, you are responsible for the waste from "cradle to grave". The liability of the waste product does not always end with disposal. If your disposal location is designated a Superfund site at a later date, you, as the generator of the waste, are required to pay for cleanup.
With the many requirements on packaging and waste segregation, generators selecting a dishonest contractor can find their costs increasing. Low initial bids on waste streams can compound as unnecessary additional drums are generated.
Regulations
Federal waste regulations derive from the 40 CFR while transportation requirements are found in the 49 CFR. Some states may require regulations more stringent than federal requirements, many states, like California, Connecticut, and Minnesota have their own specific laws.
